Question by anonymous: HIPPA LAW, is there an exception for people who have addictions ?
I have a hypothetical assignment for a class and I need to know can a person ask their parents’ doctor about their medical records if the parents are on drugs and have an addiction ? I know there are doctor-patient confidential restrictions, but is there an exception ?

There are almost no Exceptions to the Doctor-patient confidentiality restriction.

Only time I remember reading about it is if the Doctor KNOWS for a FACT that his patient will kill someone, or cause harm, the doctor can report it to the police.

No, there is no exception for the general public. The only way you could get that record is by the legal system or the person subject of the records giving permission.

You would have to subpoena the records or get a written release from your parents. If there is a problem at home, you need to contact Child Protective Services. If they open a case for you, you will be appointed a Guardian Ad Litem to look out for your welfare, that person or CPS can subpoena the medical records with sufficient cause.
